  1. Introduction

    This Privacy Policy sets out how we, PT ICE Messenger Indonesia. (“IndoChat”), use and protect your personal data that you provide to us, or that is otherwise obtained or generated by us, in connection with your use of our cloud-based messaging services, features, software, and website (together, the “Services”). For the purposes of this Privacy Policy, ‘we’, ‘us’ and ‘our’ refers to IndoChat, and ‘you’ refers to you, the user of the Services.

    1. Privacy Principles:

      IndoChat has two fundamental principles when it comes to collecting and processing private data:

      • We don't sell any of our users data to any other third party or company

      • We only store the data that IndoChat needs to function as a secure and feature-rich messaging service.

    2. Terms of Service:

      This Privacy Policy forms part of our Terms of Service, which describes the terms under which you use our Services and which are available at IndoChat website. This Privacy Policy should therefore be read in conjunction with those terms.

    3. Legal Ground for Processing Your Personal Data

      We process your personal data on the ground that such processing is necessary to further our legitimate interests (including: (1) providing effective and innovative Services to our users; and (2) to detect, prevent or otherwise address fraud or security issues in respect of our provision of Services), unless those interests are overridden by your interest or fundamental rights and freedoms that require protections of personal data.

  3. What Personal Data and Information We Use
    1. Your Account Information:

      You provide your mobile phone number to create an IndoChat account. You provide us the phone numbers in your mobile address book on a regular basis, including those of both the users of our Services and your other contacts. You confirm you are authorized to provide us such numbers. You may also add other information to your account, such as a profile name, profile picture.

    2. Phone Number and Contacts

      IndoChat uses phone numbers as unique identifiers so that it is easy for you to switch from SMS and other messaging apps and retain your social graph. We ask your permission before syncing your contacts.

      We store your up-to-date contacts in order to notify you as soon as one of your contacts signs up for IndoChat and to properly display names in notifications. We only need the number and name (first and last) for this to work and store no other data about your contacts.

    3. Your Connections

      To help you organize how you communicate with others, we may create a favorites list of your contacts for you, and you can create, join, or get added to groups and broadcast lists, and such groups and lists get associated with your account information.

    4. Your E-mail Address

      When you enable 2-step-verification for your account or store documents using the “Forget Password” feature, you can opt to set up a PIN code recovery email. This address will only be used to send you a PIN code recovery email if you forget it.

  5. How We Use Information

    We use all the information we have to help us operate, provide, improve, understand, customize, support, and market our Services.

    1. Our Services:

      We operate and provide our Services, including providing customer support, and improving, fixing, and customizing our Services. We understand how people use our Services and analyze and use the information we have to evaluate and improve our Services, research, develop, and test new services and features, and conduct troubleshooting activities. We also use your information to respond to you when you contact us. We use cookies to operate, provide, improve, understand, and customize our Services.

    2. Verifying:

      Verifying your identity, such as through sending you a verifying mobile message (as the case maybe).

    3. Safety and Security:

      We verify accounts and activity and promote safety and security on and off our Services, such as by investigating suspicious activity or violations of our Terms, and to ensure our Services are being used legally.

    4. No Third-Party Banner Ads.

      We do not allow third-party banner ads on IndoChat. We have no intention to introduce them, but if we ever do, we will update this policy.

  7. Information You and We Share

    You share your information as you use and communicate through our Services, and we share your information to help us operate, provide, improve, understand, customize, support, and market our Services.

    1. Account Information:

      Your phone number, profile name and photo, online status and status message, last seen status, and receipts may be available to anyone who uses our Services, although you can configure your Services settings to manage certain information available to other users.

    2. Your Contacts and Others.

      Users with whom you communicate may store or reshare your information (including your phone number or messages) with others on and off our Services. You can use your Services settings and the block feature in our Services to manage the users of our Services with whom you communicate and certain information you share.

    3. Third-Party Providers.

      We work with third-party providers to help us operate, provide, improve, understand, customize, support, and market our Services. When we share information with third-party providers, we require them to use your information in accordance with our instructions and terms or with express permission from you.

    4. Third-Party Services.

      When you use third-party services that are integrated with our Services, they may receive information about what you share with them. For example, if you use a data backup service integrated with our Services (such as iCloud or Google Drive), they will receive information about what you share with them. If you interact with a third-party service linked through our Services, you may be providing information directly to such third party. Please note that when you use third-party services, their own terms and privacy policies will govern your use of those services.

    5. Law Enforcement Authorities

      If IndoChat receives a court order that confirms you're a terror suspect, we may disclose your IP address and phone number to the relevant authorities. So far, this has never happened. When it does, we will include it in a semiannual transparency report published.

    6. Assignment, Change of Control, And Transfer

      All of our rights and obligations under our Privacy Policy are freely assignable by us to any of our affiliates, in connection with a merger, acquisition, restructuring, or sale of assets, or by operation of law or otherwise, and we may transfer your information to any of our affiliates, successor entities, or new owner.

    If you would like to manage, change, limit, or delete your information, we allow you to do that through the following tools:

    1. Services Settings.

      You can change your Services settings to manage certain information available to other users. You can manage your contacts, groups, or use block feature to manage the users with whom you communicate.

    2. Changing Profile Name and Picture, and Status Message.

      You can also change your profile name, profile picture, and status message at any time.

  11. Keeping Your Personal Data Safe
    1. End-to-End Encrypted Data

      Your messages, media and files, as well as the contents of your calls and the data you store in our Service are processed only on your device and on the device of your recipient. Before this data reaches our servers, it is encrypted with a key known only to you and the recipient. While IndoChat servers will handle this end-to-end encrypted data to deliver it to the recipient, we have no ways of deciphering the actual information. In this case, we neither store nor process your personal data, rather we store and process random sequences of symbols that have no meaning without the keys which we don’t have.

    2. Retention

      Unless stated otherwise in this Privacy Policy, the personal data that you provide us will only be stored for as long as it is necessary for us to fulfill our obligations in respect of the provision of the Services.

    Cookies are small text files that are placed on your device by a web server when you access our website. We use cookies to improve your experience on our website by identify your access and monitor usage and web traffic on our website to customize and improve our products and services.
